If you are located in the European Economic Area, please note that our services are currently directed at UK-based organisations; we will notify you of any specific EU adequacy or transfer arrangements relevant to your jurisdiction.

3. How we use your personal data

We use your personal data only for the purposes described below. We will not use your data for any purpose that is incompatible with these stated purposes without notifying you first.

  • Providing and managing our Platform — creating and managing your account, providing access to features, delivering technical support, and managing subscription renewals and billing.
  • Responding to enquiries and demo requests — processing contact and demo request forms, scheduling calls, and answering pre-sales questions.
  • Improving our services — analysing aggregated usage patterns, identifying and fixing bugs, conducting customer satisfaction research, and developing new product features.
  • Marketing and communications — sending you product updates, industry insights, event invitations, and promotional materials, where you have consented or where we have a legitimate interest as an existing customer. You may opt out at any time.
  • Security and fraud prevention — monitoring for suspicious activity, detecting and preventing security incidents, enforcing our acceptable use policies, and protecting the integrity of our Platform.
  • Legal and regulatory compliance — meeting our legal obligations, responding to lawful requests from regulators or courts, and maintaining records required under applicable law.
  • Business operations — internal administration, financial reporting, corporate due diligence, and merger or acquisition processes, subject to appropriate confidentiality obligations.

We always identify a lawful basis before processing your personal data. The applicable basis depends on the specific purpose:

Performance of a contract

UK GDPR Art. 6(1)(b) — processing necessary to fulfil our subscription agreement with you, including providing Platform access, managing billing, and delivering support.

Legitimate interests

UK GDPR Art. 6(1)(f) — improving our services, preventing fraud and abuse, direct marketing to existing customers, and internal administration. We balance these interests against your rights.

Consent

UK GDPR Art. 6(1)(a) — where you have given clear, freely given consent, such as subscribing to our newsletter or agreeing to non-essential cookies. You may withdraw consent at any time.

Legal obligation

UK GDPR Art. 6(1)(c) — where processing is necessary to comply with UK law, including tax record-keeping under HMRC requirements, or responding to lawful regulatory requests.

6. International transfers

We primarily store and process personal data within the United Kingdom and the European Economic Area. Where we transfer data to countries outside the UK that do not benefit from a UK adequacy decision, we ensure adequate protections are in place by using one or more of the following mechanisms:

  • UK International Data Transfer Agreement (IDTA) — the UK standard contractual clauses approved by the ICO.
  • EU Standard Contractual Clauses (SCCs) — where applicable and recognised under UK law.
  • Binding Corporate Rules (BCRs) — for transfers within corporate groups that have BCRs approved by a competent supervisory authority.
  • Adequacy decisions — where the Secretary of State for Digital has determined that the destination country provides adequate protection.

You may request a copy of the relevant transfer mechanism by contacting us at privacy@vigilantgrc.com.

7. Security of your data

We implement appropriate technical and organisational measures to protect your personal data against unauthorised access, accidental loss, destruction, or disclosure. Our security measures include:

  • Encryption of data in transit using TLS 1.2 or higher.
  • Encryption of data at rest using AES-256 encryption.
  • Multi-factor authentication (MFA) for all staff accessing production systems.
  • Role-based access controls limiting access to personal data on a need-to-know basis.
  • Regular penetration testing and vulnerability assessments by independent third parties.
  • Continuous security monitoring, logging, and incident alerting.
  • Regular security training for all staff who handle personal data.

9. Automated decision-making and profiling

We do not use your personal data to make decisions about you using solely automated means that produce legal or similarly significant effects. Any automated processing we carry out (for example, lead scoring for sales prioritisation) involves human review before any significant action is taken and does not produce legally binding outcomes for you.

If this position changes, we will update this policy and, where required, seek your explicit consent in advance.
